Suite Maintenance and Upgrades

    One area of uncertainty with many Life Lease facilities is the requirement for suite maintenance and/or upgrades to the suite or it's contents. Many questions go unanswered or are unclear. Following are a few examples:

  1. Who is responsible for repainting of a suite when it is needed?
  2. Who is responsible for repairs to appliances, flooring, faucets etc.?
  3. If an appliance has been upgraded by the tenant, who repairs or replaces it if needed? Is the replacement of a similar quality as the upgrade or the original? At whose expense? What if the appliance was in the suite when the tenant took over the lease?
  4. If flooring is worn through normal use, who replaces it and at whose expense.
  5. If a new tenant is taking over the lease, are suites automatically repainted and renewed?

    Answers to these and many other similar questions often are not clear or detailed and leave many tenants confused. Many of the answers are in the Residential Tenancies ACT. This ACT which governs Life Leases is quite complex for the average person and may require tenants to seek help.

 

   "If Tenants need help in this area and not sure who is resposible for the maintenance they should contact the Residential Tenancies Branch as they are the authority that govern Life Leases."

 

Note:  Individual Life Leases cannot contradict the ACT
